Kampala, January 3rd, 2017; Buganda road court magistrate Gladys Kamasanyu has granted a 50m shillings none cash bail to Swaibu Nsamba Gwogyolonga who has spent over two weeks on remand at Luzira prison. Nsamba is being charged with offensive communication and libel as per section 25 of the Computer Misuse Act 2002 and section 179 of the Penal Code Act respectively.
Magistrate Kamasanyu fixed 11th January 2017 as hearing date for Nsamba’s case. Meanwhile Prosecution had paraded two CID officers as witnesses claiming to be ready to resume the hearing, however the defence objected to prosecution’s demands on grounds that state had not served them with necessary documents to prepare their defence.
The Magistrate ruled that the defence counsel be served with all the necessary documents before the hearing date of 11th January 2017.
Prosecution alleges that between 8th September and 26th October, Nsamba while in unknown location willingly posted offensive communication on Facebook with intent to disturb the peace of the president. It further alleges that Nsamba defamed the person of the president with the same Facebook post.
