Court charges an online activist with libel and offensive communication, remanded to prison.

Kampala, December 19th, 2016; Buganda road court magistrate Gladys Kamasanyu has today remanded Swaibu Nsamba Gwogyolonga to Luzira prison after he pleaded not guilty to charges of offensive communication and liable as per the section 25 of the Computer Misuse Act 2002 and section 179 of the Penal Code Act respectively.

Prosecution alleges that between 8th September and 26th October, Nsamba while in unknown location willingly posted offensive communication on Facebook with intent to disturb the peace of the president. It further alleges that Nsamba defamed the person of the president with the same Facebook post.

Nsamba was arrested on Friday 9th December 2016 following his Facebook post expressing how he will announce and mourn the death of president Yoweri Museveni. He was released on police bond and has since appeared twice for his police bond (12th and 15th) December respectively, however, his bond was extended to 22nd December 2016 when he was expected to report back at Kibuli CID headquarters.

In the twist of events, police reached him on Sunday 18th December 2016 via telephone call and requested him to collect his mobile phone, which was confiscated by police as exhibit. Up on reaching Kibuli police, Nsamba was informed that his file was ready and that he was to appear before court today.

At 2:00pm Nsamba was produced before Buganda road court Magistrate Gladys Kamasanyu who dramatized the hearing by shunning the photo copy of the practicing certificate for the defense counsel. The magistrate based on this ground to remand Nsamba to Luzira until 3rd January 2017.
